Terms and Conditions

Agreement

These Terms and Conditions (“Terms”) govern your access to and use of SUMMER and summer-stems.com. SUMMER is provided by Double Cassette Inc. (“Double Cassette,” “we,” “us,” or “our”). By downloading, purchasing, activating, or using SUMMER, you agree to these Terms. If you do not agree, do not use the software.

Purchases through Polar

Polar Software, Inc. acts as the merchant of record and authorized reseller for SUMMER. Your checkout transaction is also governed by Polar’s Buyer Terms and applicable payment-provider terms. Polar handles payment, taxes, invoices, receipts, license-key delivery, and transaction-related customer service.

License

Subject to payment and compliance with these Terms, Double Cassette grants the purchaser a limited, non-exclusive, non-transferable, revocable license to install and use SUMMER for lawful personal or commercial audio work. The license is perpetual for the purchased major version unless the product listing expressly states otherwise.

Use is subject to the activation limit associated with the purchased license. You may release an activation from a Mac and reactivate it as permitted by the software and Polar’s licensing service. A brief internet connection is required for activation and periodic validation; the software provides a limited offline grace period after successful validation.

Demo mode

Without an active license, SUMMER may be used in demo mode to process full-quality excerpts of limited duration. Demo limitations may change as the product evolves.

Restrictions

You may not sell, sublicense, rent, share, publish, redistribute, or make the software or license key available to another person; circumvent licensing or usage limits; or reverse engineer, decompile, or modify SUMMER except where applicable law expressly permits it. You may not use SUMMER in a way that violates law or the rights of others.

Your files and responsibilities

You retain ownership of your audio and other files. You are responsible for having the rights needed to process them, following the preparation requirements shown in SUMMER, reviewing all results before delivery or release, and maintaining backups. SUMMER modifies copies or creates new output files; it is not a substitute for archival backups or professional review.

System requirements, updates, and support

Compatibility requirements are stated on the product and checkout pages. Operating-system, hardware, third-party service, or format changes may affect compatibility. We may provide updates, fixes, or improvements, but do not promise any particular update, feature, compatibility period, or response time unless separately agreed in writing.

Ownership

SUMMER, its algorithms, software, design, branding, documentation, and related intellectual property are owned by Double Cassette and its licensors. These Terms grant a license to use the software; they do not transfer ownership.

Refunds

Purchases are governed by our Refund Policy, Polar’s applicable buyer terms, and any non-waivable consumer rights.

Disclaimers

To the maximum extent permitted by law, SUMMER and the website are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that SUMMER will satisfy every workflow, operate without interruption or error, or produce a subjectively preferred result. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Double Cassette will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost revenue, profits, data, business, or opportunities arising from SUMMER or the website. Our aggregate liability relating to SUMMER will not exceed the amount you paid for the product giving rise to the claim. These limits do not apply where prohibited by law.

Termination

Your license may be suspended or terminated if you materially violate these Terms, misuse a license key, commit fraud, or if required by law or a payment or licensing provider. Provisions that by their nature should survive termination will remain in effect.

Changes

We may update these Terms for future use of the website or future product versions. Material changes will be identified by the effective date above. Changes do not retroactively reduce rights already granted with a completed purchase unless required by law or agreed with you.
